Studies in the area of evaluating asset safeguarding and data integrity have usually dealt with evidential evaluation procedures and the judgment decisions taken by the auditors during initial and subsequent audits. The qualities, measures and techniques of asset safeguarding and data integrity when examined jointly relate a degree of concern for cost-effectiveness considerations, internal controls and the effects of making global judgments using piecemeal evidence. Whilst the development of a crime-proof computer operating system seems very unlikely, more could be done to deter, discover, litigate and punish computer criminals. Because of the limited sophistication of security devices, experts shy away from them, while managers and attorneys (unaware of their limited sophistication) refrain from using security devices either because of their high cost or in the erroneous belief that computer crime is a low risk. To control computer crime, the computer experts should assist both management and the legal community, especially where management loosely carries out the existing policies, procedures, and preventive controls, giving a false impression of high security which makes it even more difficult to discover and gather evidence of crime.

"Forensic audits are investigative audits that aim at detecting the likelihood, magnitude and risk
of irregularities in financial statements. In contrast with the traditional audit of financial statements, this study focuses on auditing statements posted on Internet web sites. Since most

Since most publicly traded companies are moving towards posting their financials on the Internet, this method of auditing may become more and more popular, as well as cost effective. Even if a publicly traded company does not post its own financial statements on the web, other companies are

providing this service, as well as the Securities and Exchange Commission. The forensic auditor can provide effective expert witness testimony and computer litigation support regarding overstated revenue sales fraud.

 

This study describes a software based fraud detection expert system (ES) using a simulated

case study of the hospital and medical service plan industry. Typically, this system will run

on the Internet, scans the audited company’s financial statements and analyzes the differences

between trends of the company’s annual reports (for about 10 years). It also identifies red

flags that substantially differ from the norms in the industry. When it detects such deviations,

it points out the suspicious accounts, such as the Net Sales account. Furthermore, it highlights

the direction of the deviations, such as an over statement rate of 10% and the corresponding

offsetting accounts. This study describes how the system can be validated in a classroom simulation of “cops and robbers.” The robbers perpetrate a fraud on a company, and the cops try to spot it and explain

it. The ultimate use of such a system will be to continuously run it on the Internet and e-mail

alerts to the forensic auditor any time it detects red flags."

This is a study of the role of the forensic accountant in calculating damages using the “but if”

analysis in a case of Internet day trader and broker misconduct litigation. The day trader

makes several claims that the forensic accountant can validate. For example, the trader claims

that the broker pressures the trader to take excessive risk and focus on NASDAQ’s most risky

Internet stock trades. The forensic accountant can quantify the risk of the different stock markets

and sectors. For this purpose, the forensic accountant calculates the variance for the different

stock markets and sectors, leading to the conclusion that indeed the NASDAQ is significantly

more risky than other stock exchanges. Likewise, the Internet stocks are much more

volatile than other sectors, and therefore, much more risky. Forensic accountants are better

suited to deal with such cases when special accounting issues arise. These issues may include

income taxes, trust accounting, money laundering, reconstructing financial statements as well

as cash collection issues. Furthermore, the forensic accountant can deploy the “But If” analysis

to show what would have happened had certain actions been avoided. In our case, what

would have happened had the online broker not pulled the power plug on the PC (Personal

Computer) of the day trader, forcing him to suspend his trade. The forensic accountant can calculate

the profits that the trader would have earned had the broker allowed him to conclude

his exit plan and cover his short position, before the stock market trend reversed itself.

Sarbanes-Oxley Microsoft® Accelerator Forensic Accounting,

Expert Witness Testimony, and Computer Litigation Support

Description/Objectives:

Sarbanes-Oxley Microsoft Accelerator Forensic accounting workshop demonstrates how Accounting academics and practitioners can use Microsoft Share Point Team Services and Share Point Server to assist an internal audit team in implementing, investigating, and improving compliance audit services. It describes how to become an Accounting Expert Witness and how to provide Expert Witness Testimony, with an emphasis on HIPAA (Health Insurance Portability and Accountability), Sarbanes-Oxley, and Basel II Compliance Forensic Accounting.

 

We will discuss R&D for experienced expert witnesses, including the issues of dealing with the forensic team of professionals. This workshop focuses on using forensic accounting techniques in general, and providing Computer Litigation Support in particular. The workshop objectives include helping experienced expert witnesses to review their skills and upgrade them, while demonstrating to prospective expert witnesses the nature of the work, its intellectual challenges and financial opportunities and rewards. We plan to meet such objectives, by lectures, role playing, demonstrations, and most importantly active participation of the audience as well as discussions and arguments of pros and cons of various issues.

 

Format/Structure:

DVDs for litigation support, including the pros and cons of different standards such as DVD+/-RW/VR (Digital Versatile Disk, Read Write, and Video Recording), DVD-RAM (Random Access Memory), HD (High Definition)-DVD, Blu-Ray DVD, DVD Copying, dubbing, burning, and recording, focusing on the technical and legal facets.

 

Intended Audience:

This study targets practicing and academic litigation and litigation support team members, including lawyers, economists, accountants, auditors, doctors, engineers, corporate executives, expert witnesses, plaintiffs and defendants, as well as students and others interested in the topic. This workshop will review the financial opportunities for expert witnesses, fee structures, relationship with the legal profession, opportunities for students that want to specialize in the area of forensic accounting and litigation support, and/or combine the study of accounting and law, and computer information systems.
